In November of last year, the FTC along with various other federal agencies released new model privacy notices. These new notices offer a “safe harbor” to those businesses that employ the exact format. Older privacy notices that contain language from the original Privacy Rule will not provide dealers with a “safe harbor” after December 31, 2010. By the way, “safe harbor” means that your notice will be presumed to be compliant so long as you adhere to the exact specifications of the new model notices. And, when we say “exact specifications” we mean it. Ultimately, this means that dealers should be very careful when creating their new notices. Fortunately, we made it easy with our new Privacy Rule Guide. This guidebook not only explains all the technical information sharing rules, but it also provides you with four sample privacy notices to choose from. Each notice permits different levels of information sharing. And, to make it even easier, we provide you with links to editable versions of each model notice.
